Step 4 - Filing

Final Step to Protecting You, Your Family, and Your Property

When you met with attorney Frank Coxwell or attorney Rachel Coxwell, (Step 3 - Consultation), and decided to move forward with filing either a Chapter 7 or a Chapter 13 bankruptcy case, they will have then explained the first counseling required by the court that must be completed prior to filing. You can do this either over the phone or online. If you have not done this yet, be sure to do this before you come in to file your case. This first course takes about 30-45 min to complete. We must file your certificate of completion with your case.

To file your case, you will need to set up another appointment with attorney Frank Coxwell or attorney Rachel Coxwell to review your bankruptcy petition papers, sign, and date the necessary forms. Your case is electronically filed within the hour. Filing puts you, your family, and your property under the protection of the court. We will provide you with your case number and if needed, we will contact the necessary creditors to stop any pending foreclosure, repossession, or garnishment actions immediately.

After filing your case, you will then be required to attend the “341 hearing”. This date will be set by the court approximately 4-6 weeks following the date of filing of your bankruptcy case. Your attorney (either Frank Coxwell or Rachel Coxwell) will be at that meeting with you. This meeting normally lasts around 5 minutes. You will meet the Trustee assigned to your case, present proper ID, and answer a few basic questions. We will have provided and reviewed this with you beforehand. You will need to arrive one-half hour early so you can watch a few cases before your turn comes up. Our office will call you a few days before to remind you and if needed, put you on the phone with your attorney to answer any other questions you may have prior to attending this hearing.

When we meet to file your case, your attorney will explain the final counseling course required by the court. You will need to complete this final course sometime between when we filed your case and before you attend the 341 hearing. This course has a required time limit of approx. 2 hours, so take your time going through this if you complete the course online. If you choose to complete this course over the phone with a counselor, then they will set the pace to meet all time requirements.

In a Chapter 7, you can expect to receive your official Discharge Order signed by the Judge within 4-5 months from the date of filing. In a Chapter 13, it depends on whether or not you choose a 3, 4, or 5 yr plan along with a few other factors that we will discuss when we file your Chapter 13 case. Regardless of the length of the Plan you choose, we walk this out with you until it is complete.
